2. Scope of Application
These Terms & Conditions of Sale (“Terms”) apply to all sales of products made through the website www.toboggankids.com to consumers worldwide. By placing an order on our website, you agree to be bound by these Terms.

3. Products
All product descriptions, images, and prices are provided for informational purposes. While we make every effort to display our products accurately, slight variations in color or appearance may occur.

4. Prices and Taxes

• All prices displayed on our website are in Euros (EUR) and include French VAT for customers within the European Union.

• For deliveries outside the EU, VAT will not be charged, but local customs duties and import taxes may apply.

• Any customs duties, import taxes, or local charges are the responsibility of the customer. These costs are not collected by Toboggan Kids but may be billed directly by the carrier upon delivery.
   

5. Payment
We accept payments processed securely via Stripe, including Visa, Mastercard, Maestro, and American Express.
Payment is required in full at the time of ordering.

6. Delivery

• Shipping is managed through Easyship, which works with carriers such as Chronopost, La Poste, DHL, and others.

• Customers may select their preferred shipping option during checkout.

• Estimated delivery times are provided at checkout but are not guaranteed.

• Toboggan Kids is not responsible for delays caused by customs clearance or the carrier.
   

7. Right of Withdrawal & Returns
In accordance with European consumer law, customers have a legal right of withdrawal and may return their purchase within 14 days of receiving the order, without giving any reason.

Conditions for Returns
To be eligible, items must be:

• Unworn and unwashed

• In their original condition

• With all tags and packaging intact

We reserve the right to refuse a refund or deduct an amount if the product shows signs of use or damage.

Return Costs

• Customers are responsible for return shipping costs.

• Return shipping costs are non-refundable.
   

Refunds

• We will refund the price of the returned product(s) and any standard shipping fees paid at purchase.

• Additional costs for express or premium delivery are non-refundable.

• Refunds will be processed within 14 days of receiving the returned items.

• Refunds are made using the same payment method used at the time of purchase.

8. Warranty
All products sold by Toboggan Kids benefit from the legal guarantee of conformity and the legal guarantee against hidden defects as provided under French law and EU consumer protection law. No additional commercial warranty is offered.

9. Liability
Toboggan Kids cannot be held liable for indirect damages, loss of profit, or any damages resulting from misuse of the product. Our liability is limited to the amount of the order.

11. Governing Law & Dispute Resolution
These Terms are governed by French law.
In the event of a dispute, customers may use the European Commission’s Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr
If the dispute cannot be resolved through mediation, it will fall under the exclusive jurisdiction of the courts of France.
